I will only collect, process and use your personal data with your consent or mandate or order for the purposes agreed with you or when another legal basis exists in accordance with the GDPR; this will be done in compliance with data protection and civil law regulations.
Only personal data that is necessary for the performance and processing of our legal services will be collected, or that you have voluntarily provided to us.
Personal data is all data that contains individual information about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photos, voice recordings of individuals, and biometric data such as fingerprints. Sensitive data, such as health data or data related to a criminal investigation, may also be included.
As a client or client, or generally as a data subject, you have the right at any time – subject to the legal obligation of professional secrecy – to obtain information about your stored personal data, their origin and recipients, and the purpose of data processing, as well as the right to rectification, data transfer, objection, restriction of processing, and the blocking or deletion of incorrect or unlawfully processed data.
Insofar as changes to your personal data occur, we kindly request that you inform us accordingly.
You have the right at any time to revoke a given consent to the use of your personal data. Your request for information, deletion, correction, objection and/or data transfer, in the latter case provided that this does not entail an unreasonable burden, can be addressed to the law firm mentioned in point 10 of this statement.
If you believe that the processing of your personal data by us violates applicable data protection law or that your data protection rights have been violated in any other way, you have the option to file a complaint with the competent supervisory authority. In Austria, the data protection authority is responsible for this.
The protection of your personal data is ensured through appropriate organizational and technical measures. These measures primarily concern the protection against unauthorized, illegal or accidental access, processing, loss, use and manipulation.
Despite the efforts to maintain an always appropriate level of diligence requirements, it cannot be ruled out that information that you disclose to us via the Internet may be viewed and used by other persons.
Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission caused by us and/or unauthorized access by third parties (e.g., hacking of email accounts or phones, interception of faxes).
We will not process the data provided to us for purposes other than those covered by the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR. Exceptions to this include the use for statistical purposes, provided that the data provided has been anonymized.
To fulfill your order, it may also be necessary to forward your data to third parties (e.g., counterparties, substitute parties, insurers, service providers with whom we cooperate and to whom we provide data, etc.). The forwarding of your data takes place exclusively based on the GDPR, specifically to fulfill your order or based on your prior consent.
Furthermore, we inform you that as part of our legal representation and support, we regularly obtain factual and case-specific information from third parties as well.
Some of the recipients of your personal data mentioned above are located outside your country or process your personal data there. The level of data protection in other countries may not be equivalent to that in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection, or we implement measures to ensure that all recipients have an adequate level of data protection, for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).
We are committed to ensuring that data breaches are detected early and, if necessary, reported to you or the relevant supervisory authority without delay, taking into account the relevant data categories affected.
We will not store data for longer than is necessary to fulfill our contractual or legal obligations and to defend against any liability claims.
